These Terms of Use ("Terms") form a binding agreement between you ("Subscriber" or "you") and Witty Wilma, Inc. ("ABA Weekly," "Company," "we," or "us"). These Terms govern your subscription to the ABA Weekly newsletter and use of the ABA Weekly website (collectively, the "Service").
BY SUBSCRIBING TO ABA WEEKLY OR USING OUR WEBSITE, YOU (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS; (B) REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTER INTO A BINDING AGREEMENT; AND (C) ACCEPT THESE TERMS AND AGREE TO BE LEGALLY BOUND BY THEM.

By subscribing to ABA Weekly, you will receive:
- Our weekly newsletter with curated ABA industry news, research, and updates.
- One edition for all subscribers, with your state called out in the legislation section if you provide it.
- Occasional announcements about new features or offerings.
You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us directly.
2. Content Ownership and Use
All content provided through ABA Weekly, including but not limited to articles, summaries, analysis, and other materials (collectively, "Content"), is owned by or licensed to Witty Wilma, Inc. and is protected by copyright and other intellectual property laws.
- You may read, share, and reference our Content for personal and professional purposes.
- You may not reproduce, redistribute, or republish our Content for commercial purposes without our written permission.
- Attribution is required when sharing or quoting our Content.
3. AI-Generated Content
ABA Weekly uses artificial intelligence to help draft summaries of source material. While we strive for accuracy:
- AI-generated summaries may not capture all nuances of the original source material.

4. What You Send Us
Our contact form invites corrections, story tips, and news from your state. You keep ownership of anything you send. Please do not send confidential information, protected health information, or anything you are not free to share — this is a newsroom inbox, not a secure channel.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WITTY WILMA, INC. OR ITS AFFILIATES, OR ANY OF ITS OR THEIR RESPECTIVE LICENSORS OR SERVICE PROVIDERS, HAVE ANY LIABILITY ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM FOR: (A) PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, COST OF SUBSTITUTE GOODS OR SERVICES, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COMPUTER FAILURE OR MALFUNCTION, OR ANY OTHER CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES; (B) DIRECT DAMAGES IN AMOUNTS THAT IN THE AGGREGATE EXCEED $100.
THE FOREGOING LIMITATIONS WILL APPLY WHETHER SUCH DAMAGES ARISE OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE AND REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR COMPANY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY SO SOME OR ALL OF THE ABOVE LIMITATIONS OF LIABILITY MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify and hold harmless Witty Wilma, Inc., its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Modifications
We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
13. Termination
We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.
14. Service Availability
Witty Wilma, Inc. may, at any time and without prior notice or liability:
- Modify, suspend, or discontinue, temporarily or permanently, the Service or any features or portions thereof;
- Restrict or deny access to the Service to any user, at its sole discretion, with or without cause;
- Impose limits on certain features and tools or restrict your access to parts or all of the Service.
Witty Wilma, Inc. does not guarantee any uptime, availability, or uninterrupted access to the Service. Witty Wilma, Inc. shall not be liable to you or to any third party for any modification, suspension, or discontinuation of the Service or any part thereof.
15. Reservation of Rights
You do not acquire any ownership interest in the Service under these Terms, or any other rights thereto other than to use the Service in accordance with these Terms. Witty Wilma, Inc. and its licensors and service providers reserve and shall retain their entire right, title, and interest in and to the Service, including all patents, copyrights, trademarks, and other intellectual property rights therein or relating thereto, except as expressly granted to you in these Terms.
16. Third-Party Materials
The Service may display, include, or make available other third-party content (including data, information, applications, and other products, services, and/or materials) or provide links to third-party websites or services ("Third-Party Materials"). You acknowledge and agree that Witty Wilma, Inc. is not responsible for Third-Party Materials, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality, or any other aspect thereof. Witty Wilma, Inc. does not assume and will not have any liability or responsibility to you or any other person or entity for any Third-Party Materials. Third-Party Materials and links thereto are provided solely as a convenience to you, and you access and use them entirely at your own risk and subject to such third parties' terms and conditions. You understand that it is your responsibility to check the accuracy, credentialing, and licensing of any Third-Party Materials. Our role is strictly limited to providing access to information for your consideration.
17. Geographic Restrictions
The Service is based in the United States and provided for access and use only by persons located in the United States. You acknowledge that you may not be able to access the Service outside of the United States and that access thereto may not be legal by certain persons or in certain countries. If you access the Service from outside the United States, you are responsible for compliance with local laws.
18. Export Regulation
The Service may be subject to US export control laws, including the Export Control Reform Act and its associated regulations. You shall not, directly or indirectly, export, re-export, or release the Service to, or make the Service accessible from, any jurisdiction or country to which export, re-export, or release is prohibited by law, rule, or regulation. 19. Limitation of Time to File Claims
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES OTHERWISE SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
20. Waiver
No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder.
21. Severability
If any provision of these Terms is illegal or unenforceable under applicable law, the remainder of the provision will be amended to achieve as closely as possible the effect of the original term and all other provisions of these Terms will continue in full force and effect.
22. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts located in Alameda County, California.
23. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Witty Wilma, Inc. regarding your use of the Service.
